False Claims Act Did you know that the federal False Claims Act permits a private citizen to bring a lawsuit to recover money which may be due to the government?
A recent example of this is pending in a federal court in Florida in which a former employee of Boca Raton Regional Hospital has accused the hospital of cheating Medicare out of at least $2 million. According to the suit the hospital used the wrong billing code to collect far more federal money for treating patients with heart problems than regulations allow.
Under the Act the hospital could be forced to pay three times the amount it overbilled Medicare, and the plaintiff could recover as much as 30% of whatever damages the hospital is forced to pay.
