Granddaddy of Frivolous Lawsuits As personal injury attorneys it is extremely rare that we see a client who is faking an injury or manufacturing a case in an outright fraud. There are simply too many ways to easily determine if the story the client is telling holds water. A recent case inTampa,Florida, however, takes the cake. After pleading guilty to three driving under the influence manslaughter charges and being sentenced to 12 years in prison for a crash that killed three people, David Belniak has file a lawsuit against the now-deceased other driver claiming that the victim was at fault and seeking compensation for pain and suffering, mental anguish and loss of capacity for the enjoyment of life plus medical bills. According the police Belniak, who reportedly had alcohol and evidence of cocaine in his system, was driving his truck between 75 and 85 mph when he crashed into the back of the car driven by the victim who was stopped for a red light. His attorney is his sister, which may explain a lot.
