Both drivers were transported by ambulance to Maine Medical Center in Portland, but police said Jacobson-Maloney’s injuries appeared to be life threatening. Kristina Lowe was held in the Oxford County Jail on $25,000 bail. She is scheduled to appear in Oxford County Superior Court today. The case against Lowe may be Maine's first manslaughter case in which texting on a cellphone is alleged as a key component of the crime. "It's the first I'm aware of," said Oxford County Assistant District Attorney Joseph O'Connor. "Her blood alcohol content alone was not high enough to be an OUI, but there also was evidence of consumption of marijuana, and she was speeding, and we believe the evidence will show she was texting," O'Connor said. "A combination of all those factors amounts to criminal negligence."

Joshua Smith, 20, of Kingfield complained of back pain and was taken to Franklin Memorial Hospital, said Darin S. Gilbert, a Farmington police officer. Jennifer Dunn, 39, and her passenger, Cory Legassie, 41, both of Portland, were not injured. Gilbert said Smith was driving a white 2000 Pontiac south on Route 27 toward Farmington in a 55-mph zone when he fell asleep about 2:50 p.m. while going downhill into a curve. Dunn was driving north and uphill into the curve in a blue 2003 Suzuki Vitara sport utility vehicle when the Pontiac crossed the centerline, Gilbert said. Dunn swerved off the road to avoid a head-on collision, losing control of the SUV, he said. It slid sideways several feet uphill before rolling at least once and coming to rest upside down on its roof, precariously balanced atop a mound of dirt.

Deputy Tim Kachnovich with the Androscoggin County Sheriff’s Office said 73-year-old Anita Sellars complained of chest pain as a result of the accident and was taken to Central Maine Medical Center with injuries not considered life-threatening. A nursing supervisor at the hospital said Sunday night that Sellars was not listed as a patient. Kachnovich identified the driver of the second vehicle as Jason Osborn, 31, also of Durham, who escaped apparent injury. Kachnovich estimated damage at about $1,000 each to Seller’s 2011 Hyundai and Osborn’s 2001 Subaru in the 4:42 p.m. crash. No charges were filed.

BANGOR, Maine — A driver attempting to be nice stopped in traffic on Broadway Tuesday afternoon to let Agnes Whitaker, 91 turn left onto Falvey Street, but what the driver didn’t know was that a third motorist was coming up from behind in the other lane. Robert Valente, 47, of Bangor, didn’t realize Ms. Whitaker had been waved through, and struck the passenger side of her 2000 Hyundai. Whitaker and her passenger, Nellie Closson, 88, were taken to a local hospital emergency room. Closson had a head injury and Whitaker complained of arm pain. Valente was not injured in the collision. Both drivers had green lights and both cars were damaged enough that they had to be towed away. Similar accidents, in which a driver is trying to be polite and waves a car through, are common on busy roadways such as Broadway that have four lanes, police noted. “It does happen a lot on that street,” the sergeant said. Drivers should not assume the coast is clear even if a driver waves them through a busy intersection.

Lorrice Joyce was rear-ended while traveling on the 110 Freeway in Los Angeles, which, according to her suit, exacerbated her prior neck injuries and caused a new herniated disc at C6-7. She subsequently underwent fusion surgery for the new spinal injury nine months later. Prior to suing her insurer, Arch Insurance, Joyce had received the driver's $100,000 insurance policy limits. She then filed an underinsured motorist claim with Arch. However, Arch argued that the new herniation wasn't caused by the crash, and so refused to pay. Consequently, her suit proceeded to arbitration and she was awarded $711,532, which was reduced by $100,000 to offset the amount she received in her settlement with the driver.
